Who Is Protected?

The Act protects people who are age 18 or older, an emancipated minor, a person who shares a child with or is pregnant by the abuser, or a person in a current or former dating relationship with the abuser.

Domestic violence includes a wide range of offenses: assault, terroristic threats, harassment, stalking, kidnapping, criminal restraint, false imprisonment, sexual assault, criminal mischief, burglary, criminal trespass – among others.

Any allegations or history of domestic violence or spousal abuse will seriously impact how child custody, visitation and other family law issues are resolved.

How Restraining Orders Work in New Jersey

A victim can apply for a Temporary Restraining Order (TRO) at the county courthouse during business hours or through local police after hours. A TRO provides immediate protection and can bar the abuser from your home, workplace, and all contact.

Within approximately 10 days, a Final Restraining Order (FRO) hearing is held where both parties testify. If the court finds domestic violence occurred, an FRO is issued. In New Jersey, final restraining orders are permanent unless modified by the court. Having an attorney represent you at the FRO hearing significantly strengthens your case.

If law enforcement responding to a domestic violence incident finds probable cause, the abuser must be arrested.
