Parenting Time in South Jersey

In New Jersey, “parenting time” refers to the schedule that determines when each parent gets to spend time with their children. Whether you are establishing an initial parenting plan during divorce or custody proceedings, or seeking to modify an existing schedule, the arrangement you reach will shape your family’s daily life for years to come.

What Are the Different Parenting Time Arrangements In New Jersey?

In most parenting time arrangements, the parents are designated as follows:

Parent of primary residence – The parent with whom the child lives most of the time (more than 50% of overnights)
Parent of alternate residence – The parent who has parenting time but fewer than 50% of overnights
No residency designation – The parents spend equal time with the child.

New Jersey recognizes several parenting time arrangements, including:

Sole parenting – One parent has a substantial majority of overnight time, with the other parent afforded many potential schedules of recurring parenting time
Shared parenting – Both parents have significant overnight time, often close to equal (the threshold is typically 104+ overnights per year for the parent of alternate residence)
Split parenting – When parents have multiple children and each parent has primary custody of at least one child
Nesting arrangements – The child remains in the family home while parents rotate in and out for their parenting time (generally a temporary arrangement during divorce proceedings or a separation).

Can Parenting Time Be Modified?

Yes. When circumstances change—a new job, relocation, or a shift in the child’s needs—you may need to adjust your parenting time schedule. New Jersey courts will consider modifications when there is a substantial change in circumstances and the proposed change serves the child’s best interests.
